Acceptance of Terms

By accessing or using the website located at honoluluinsulation.com or by engaging Custom Honolulu Insulation ("Company," "we," "us," or "our") for any services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our website or services. We may update these terms at any time, and your continued use of the website or services after any changes constitutes your acceptance of the updated terms.

Description of Services

Custom Honolulu Insulation provides residential and commercial insulation services, including but not limited to spray foam insulation, attic insulation, blown-in insulation, crawl space insulation, wall insulation, air sealing, vapor barrier installation, and related services in Honolulu, Hawaii and surrounding communities. All services are subject to the terms of a written proposal or service agreement provided before work begins.

Estimates and Pricing

Written estimates provided by Custom Honolulu Insulation are based on an in-person assessment of the work area and are valid for 30 days from the date of issuance unless otherwise noted. Estimates are not final invoices. The final price may differ from the estimate if:

• Conditions discovered during the work differ materially from what was visible during the assessment.
• The customer requests changes to the scope of work after the estimate has been accepted.
• Unforeseen site conditions require additional materials or labor.

We will notify you of any material cost changes before proceeding with additional work.

Scheduling and Cancellation

Once a job date is scheduled and confirmed, we ask that you notify us at least 48 hours in advance if you need to reschedule. Late cancellations or no-shows that result in our crew traveling to a job site may be subject to a cancellation fee as described in your service agreement. We reserve the right to reschedule work due to weather conditions, supply delays, or other circumstances beyond our control, and we will provide as much advance notice as possible in those cases.

Payment Terms

Payment terms are specified in the written proposal for each project. Unless otherwise agreed in writing, payment is due upon completion of the work. For larger projects, we may require a deposit before scheduling. Accepted payment methods are described in your service agreement. Past-due invoices may be subject to a late payment fee. Custom Honolulu Insulation reserves the right to suspend or decline future services for accounts with outstanding balances.

Customer Responsibilities

To allow us to perform services properly and safely, you agree to:

• Provide safe and reasonable access to the work area on the scheduled date.
• Clear the work area of stored items, furniture, and personal belongings as directed before the crew arrives.
• Vacate the premises (along with occupants and pets) during and for the period following any spray foam application, as directed by your contractor.
• Disclose any known hazardous materials, structural defects, or conditions that may affect the work.

Warranty

Custom Honolulu Insulation warrants that all work will be performed in a workmanlike manner using materials appropriate for the scope of the project. Specific warranty terms, including duration and coverage, are set out in your written service agreement. Warranty claims must be submitted in writing within the warranty period. This warranty does not cover damage caused by misuse, alterations made by others after completion, acts of nature, or conditions that were not disclosed prior to the start of work. Manufacturer warranties on materials pass through to you to the extent permitted by the manufacturer.

Limitation of Liability

To the fullest extent permitted by applicable law, Custom Honolulu Insulation's total liability to you for any claim arising out of or related to our services or these Terms shall not exceed the amount you paid us for the specific services giving rise to the claim. In no event shall Custom Honolulu Insulation be liable for any indirect, incidental, special, or consequential damages, including lost profits or loss of use, even if we have been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion of certain damages, so the above limitation may not apply to you.

These Terms and Conditions are governed by and construed in accordance with the laws of the State of Hawaii, without regard to its conflict of law provisions. Any legal action arising out of these Terms or your use of our services shall be brought in the appropriate courts located in HI.

Policy Modifications

We reserve the right to modify these Terms and Conditions at any time. Changes will be posted to this page with an updated effective date. Your continued use of our website or services after any modifications constitutes your acceptance of the revised terms.
